FOR THE RED NOTICE BILLBOARDS

FROM NOVEMBER 12!

Terms and Conditions

1. Competition
The competition is organized by Netflix Services Germany GmbH, Friedrichstraße 88, 10117 Berlin (hereinafter referred to as "Netflix"). The implementation and processing is carried out by Agentur XY GmbH in the name and on behalf of Netflix.

A participant enters the competition by searching for the real artworks displayed on the campaign billboards in Germany within the sweepstakes period. The winner is the first person to find 1 of the 8 artworks and take it with them or legally "steal" it as part of the campaign. Netflix agrees to such a taking and agrees to a transfer of ownership to the respective winner, provided that the winner has complied with the competition terms and conditions.

The 8 artworks are original works by renowned artists Hannah Sophie Dunkelberg, Devin Troy Strother, Henrik Godsk, Pablo Tomek, Stefan Marx and Stefan Strumbel. The works are paintings and mixed media artworks on canvas and other materials (various sizes between 38 x 28 cm and 120 x 80 cm). The works will be hung in acrylic glass boxes, which are part of the prize and may be taken away.

A participant may only take or win one of the 8 artworks.

The competition period begins on November 12, 2021 and ends no later than the end of the billboard campaign on November 25, 2021. The billboards, each of which may contain one work of art, will be hung in the following cities beginning November 12, 2021: Berlin, Bremen, Dresden, Essen, Freiburg im Breisgau, Hamburg, Cologne, and Stuttgart. Netflix reserves the right not to hang all artworks at the same time and at the beginning of the competition period.

2. Participants / exclusion from the competition
Every adult, natural person may participate.

Employees of Netflix, trade partners and agencies of Netflix as well as the possibly involved cooperation partners/service providers as well as their respective relatives are excluded from participation.

In the event of a violation of these conditions of participation, Netflix reserves the right to exclude persons from the competition.

Persons who use unauthorized aids or otherwise obtain advantages through manipulation will also be excluded. In such cases, winnings may also be subsequently disallowed and reclaimed.

A cash payment of the winnings or a possible substitution of winnings is not possible in any case.

3. Consideration / access to the works of art
Participants are obliged to show consideration for other participants in the competition and other road users during their search and to observe applicable laws and regulations, in particular those relating to participation in road traffic. Participation is at the participant's own risk.

If more than one participant finds a work of art at the same time, the winner will be the one who touched it first.

Netflix will have the artwork hung in locations properly accessible to pedestrians where there is free access to the posters. The artwork may be removed from the billboard without the use of any tools. Netflix warrants that it will not itself influence the outcome of the competition.

4. Rights to the artwork / taxes
For clarification purposes only, it is pointed out that the winner acquires ownership of the respective artwork as well as rights for private use, but no further and/or commercial rights of use. Furthermore, the granting of rights agreed between the author and Netflix for the use of the work of art in the context of the campaign remains unaffected by the winning process.

The winner is responsible for the taxation of the prize.

5. Premature termination of the competition
Netflix reserves the right to cancel or terminate the competition at any time without prior notice and without giving reasons. Netflix will make use of this possibility in particular if for technical reasons or for legal reasons a proper execution of the game cannot be guaranteed (anymore). If such a termination is caused by the behavior of a participant, Netflix can claim compensation from this person for the damage caused.

6. Liability
The winner has no claim against Netflix for the surrender of the prize, since Netflix is already released from all corresponding obligations with the hanging up of the eight artwork prizes (unless an even earlier point in time results from the above conditions, such as for example in the case of the termination of the lottery according to clause 5).

Netflix is not liable for damages or material defects of the prizes that occur after the hanging up.

Netflix is only liable for damages which have been caused by Netflix or one of its vicarious agents intentionally or by gross negligence or by the negligent breach of duties which are essential for the achievement of the purpose of the contract. These limitations do not apply to damages caused by injury to life, body and/or health or to liability under the Product Liability Act.

7. Miscellaneous
Participation in the competition is subject exclusively to the laws of the Federal Republic of Germany. Legal recourse is excluded.
